الملخص
لقد اهتمت هذه الورقة البحثية بصيغة المشاركة المتناقصة المنتهية بالتمليك باعتبارها عقدا من العقود المستجدة على الساحة الفقهية الإسلامية، وهي أحد الأساليب الاستثمارية المستحدثة من طرف المؤسسات المصرفية الإسلامية، والتي بإمكانها المساهمة في تمويل واستثمار وتنمية الأملاك الوقفية، ونلمس في هذا البحث التعرف على حقيقة المشاركة المتناقصة، وضوابطها وحكمها الشرعي، ومدى إمكانية تطبيقها لتنمية الأوقاف الجزائرية على اعتبار أن الجزائر تمتلك حظيرة معتبرة من الأملاك الوقفية غير أن أغلبها غير مستغل بالطريقة الصحيحة، الأمر الذي يحول دون تأديتها للدور الاقتصادي المنوط بها.
