الملخص

تهدف هذه الورقة البحثية الى تسليط الضوء على تمويل السكن باعتباره ضرورة أساسية لحياة الانسان، وبما أن التمويل العقاري التقليدي يقوم على أساس ربوي، بناءا على ذلك استحدثت البنوك الاسلامية عددا من الأساليب المتوافقة مع الشريعة الاسلامية فيما يتعلق بملكية المساكن، لذا تطرقنا الى اهم آلية وهي المشاركة المتناقصة والتي يتم تطبيقها على نطاق واسع في ماليزيا و كندا، باكستان، والعديد من الدول الاخرى، وخلصت الدراسة في الاخير الى ان عقد المشاركة المتناقصة اكثر أساليب التمويل العقاري كفاءة و تطورا حيث تعتمد على شراكة حقيقية متوافقة مع مقاصد الشريعة الاسلامية وتنفي وجود اي تعامل ربوي يمكن ان يكون محل للشك، وتوصي الدراسة بضرورة العمل على مزيد من التعديلات التنظيمية وانشاء مؤشر للتأجير لتوليد بيئة أكثر ملائمة لتنفيذ نموذج المشاركة المتناقصة في التمويل العقاري. Abstract: The aim of this research paper is To focus on housing finance As house Is a fundamental necessity of human life ,So because of the traditional mortgage financing is based on interest, the Islamic banks introduced a number of methods compatible with Islamic law With respect to housing ownership, So we touched To the most important mechanism Which is musharakah mutanaqisah It is widely applied in Malaysia, Canada, pakistan, and many other countries, finally The study concluded that the contract of musharakah mutanaqisah More efficient and sophisticated mortgage techniques It depends on a true partnership that is consistent with the purposes of Islamic law and denies the existence of any usurious deal, It can be subject to doubt, This study recommends the need for further regulatory changes And the creation of a leasing index to generate a more favorable environment for implementing a declining participation model in real estate finance.
