الطعن الغير قضائي لمنازعات الضمان الإجتماعي المتعلقة بالبث في الطابع المهني لحادث العمل

الملخص
يكون العامل خلال حياته المهنية عرضة لعدة حوادث و التي قد ينتج عنها عجز أو وفاة، و بعد التصريح بالحادث ترفض هيئة الضمان الاجتماعي الإعتراف بالطابع المهني للحادث و تمتنع عن صرف الأداءات العينية و النقدية إما بسبب أن الحادث لم يقع بمكان و وقت العمل أو بسبب العمل أو أن العامل غير مؤمن لديها أو أن التصريح بالحادث لم يستوفي الشروط، و إما بسبب أن الإصابة ليست ناتجة عن الحادث أو لا تأخذ الهيئة بطبيعة الإصابة أو درجة و نوع العجز. و منه يثور خلاف بين الهيئة و العامل الضحية أو ذوي حقوقه، تنشأ منازعة من منازعات الضمان الاجتماعي سواءا منازعة عامة أو منازعة طبية The worker is subject to several accidents during his professional life, which may result in disability or death. After the accident declared, the social security authority refuses to recognize the professional nature of the accident and refrains from disbursing in-kind and cash payments either because the accident did not occur at the place or time of work or because of the work, or the woerker is not insured, or the accident declaration did not meet the conditions, or because the injury is not caused by the accident or the authority dost not take into account the nature of the injury or the degree and type of disability. A discute arised between the commission and the victim worker or his rights holders, the dispute arises from social security disputes, whether a public dispute or a medical dispute.
