نظرة على تنظيم الرقابة الدستورية في ضوء التعديل الدستوري الجزائري لسنة 2020

الملخص
ملخص: من أهم المستجدات التي وردت بموجب التعديل الدستوري لسنة 2020، والهادفة إلى محاولة تطور مجال الرقابة على دستورية القوانين، هو الانتقال من مجلس دستوري الى محكمة دستورية. بهذا تكون الرقابة على دستورية القوانين قد عرفت تغييرًا في الهيكل المشرف على تكريس احترام أحكام الدستور ، إضافة إلى تغيير في تشكيلة المحكمة الدستورية، أي طريقة تعيين وانتخاب أعضائها، سعيا لتكريس الرقابة السابقة، واللاحقة (اللاغية) لدستورية القوانين ، وكذا لضمان وترقية الحقوق والحريات من خلال مواصلة تدعيم آلية الدفع بعدم دستورية القوانين، آلية محدثة بموجب التعديل الدستوري لسنة 2016. كما أن التعديل الدستوري لسنة 2020 وسيع في اختصاصات المحكمة الدستورية، قصد تمكينها من النهوض بمهامها الدستورية، الرامية إلى احترام الدستور وضبط سير مؤسسات الدولة الساعية لتفعيل الرقابة على دستورية القوانين. One of the most important developments under the constitutional amendment of 2020, which aims to try to develop the oversight over the constitutionality of laws is the transition from a constitutional council to a constitutional court. With this, the oversight of the constitutionality of laws has witnessed a change in the structure supervising the observance of the provisions of the Constitution, in addition to a change in the composition of the Constitutional Court, i.e. the method of appointing and electing its members, in an effort to establish the previous and subsequent (null) constitutional oversight of laws, as well as to ensure and promote rights and freedoms from While continuing to strengthen the mechanism for the exception of the unconstitutionality of laws created by the constitutional amendment of 2016. In addition, most of the constitutional amendment of 2020 expanded the powers of the Constitutional Court in order to enable it to carry out its constitutional tasks, aimed at respecting the constitution and controlling the functioning of state institutions that seek the oversight of the constitutionality of laws.
