عقوبة جريمة الإجهاض وعوارضها في التشريع الفلسطيني.

الملخص
الملخص: يسعى الباحث في هذا البحث لتوضيح العقوبة المقررة لجريمة الإجهاض في القانون الفلسطيني، وبيان ما يترتب عليها من عقوبات قضائية كون الإجهاض هو انهاء متعمد وبلا ضرورة لحالة الحمل قبل موعد الولادة الطبيعي وهذا يعتبر جريمة يجب معاقبة كل من يرتكبها لما فيها من اعتداء على حياة الجنين والأم ومصلحة المجتمع الإنساني ككل، كما يوقع القانون عقوبات على من يرتكبها عند توافر أركانها وتحقق شروطها، وأيضاً يوجد هناك عواض تمنع المسؤولية وتنقسم إلى أسباب الاباحة وموانع المسؤولية، ان المشرع الفلسطيني لم يتناول أسباب الاباحة في قانون العقوبات الفلسطيني المطبق في غزة ولم ستطرق لأي مانع من موانع المسؤولية الذي يتم من خلاله الإعفاء من العقاب ولكن نص في مشروع قانون العقوبات الفلسطيني في المادة (254) على سبب واحد من أسباب الاباحة تتمثل في حالة الضرورة، وإن هذا البحث يهدف لتوعية المجتمع وتحذيرهم من اقتراف هذه الجريمة. Abstract The researcher seeks to clarify the penalty prescribed for the offence of abortion in Palestinian law and to indicate the legal penalties that abortion is a deliberate and unnecessary termination of pregnancy before the natural date of birth. This is an offence that must be punished for infringing on the life of the foetus and mother and in the interest of the human community as a whole, The Act also imposes penalties on anyone who commits them when their elements are available and their conditions are met. And there are also motives that prevent responsibility and are divided into reasons for prostitution and impediments to responsibility, The Palestinian legislature did not address the reasons for exclusion in the Palestinian Penal Code applicable in Gaza, nor would it address any obstacles to liability through which impunity was exempted, but the draft Palestinian Penal Code provided for in the article. (254) One of the reasons for prostitution is the state of necessity, and this research aims to raise society's awareness and warn them against the commission of this crime.
