الإجهاض وصوره في التشريع الفلسطيني "دراسة تحليلية"

الملخص
من أهم الحقوق التي تَضمَنُها قواعد الشريعة الإسلامية والتشريعات المقارنة؛ الحق في الحياة للجنين في بطن أمه، حيث يعتبر الأخير إنسانًا مثله مثل أي إنسان على قيد الحياة، ويتمتع بكثير من الحقوق، لا سيّما حقه في الحياة، وحقه في الإرث، وأنْ يوهب له، لهذا يمكن القول إنَّ جريمة الإجهاض تُعَدُّ من أخطر الجرائم الواقعة على الأشخاص، ومن هذا المنطلق جاء اهتمام الباحث لتناول هذا الموضوع موضحًا لكل ما يتعلق في جريمة الإجهاض في القانون الفلسطيني، وسوف نتناول صور جريمة الإجهاض في القانون الفلسطيني المطبق والساري المفعول في قطاع غزة، وأيضًا سوف نتطرق لما تناوله مشروع قانون العقوبات الفلسطيني الجديد، حول صور الإجهاض، وهو ما نص عليه قانون العقوبات الفلسطيني المطبق في قطاع غزة في المواد التالية: المادة (175) وهي جريمة محاولة إجهاض الحامل بفعل الغير، المادة (176) جريمة محاولة المرأة الحامل إجهاض نفسها، المادة (177) جريمة تقديم أو تهيئة العقاقير أو الآلات لإجهاض الحامل. From this point of view, the researcher's interest in dealing with this topic is an explanation of all matters relating to the crime of abortion in Palestinian law. We will address the images of abortion in the Palestinian law applicable and in force in the Gaza Strip We will also address the new Palestinian Penal Code. On abortion images, as stipulated in the Palestinian Penal Code in the Gaza Strip in the following articles: Article 175 is the offence of attempting to abort a pregnant woman by act of another, article 176 is the offence of attempting to abort the pregnant woman herself. Article 177 is the offence of providing or preparing drugs or machines to abort the pregnant woman.
