تسوية البناء غير المشروع في التشريع الجزائري

الملخص
يشهد الواقع إنتشار البنايات الفوضوية التي أثرت على البيئة والطابع الجمالي والذوق الهندسي للبناية، لذلك عمد المشرع الجزائري بموجب القانون 08-15 المتعلق بقواعد مطابقة البنايات وإتمام إنجازها إلى وضع عدة تدابير وإجراءات واجب إتباعها عن طريق تحقيق مطابقة البنايات وإتمام إنجازها، وعلى الرغم من إصدار النصوص القانونية المنظمة للعمران في الجزائر إلاّ أن الواقع أثبت عدم التخلص من هذه الظاهرة وعدم نجاعة هذه الإجراءات المتخدة في الحدّ من إنتشار البنايات الفوضوية. Society is witnessing the spread of chaotic buildings that affected the environment, the aesthetic character and the engineering taste of the building therefore the algerian legislator, according to law 08-15 related to the rules of conformity of buildings and their completion, put in place several measures and procedures that must be followed by achieving the conformity of that, but despite the fact that the issuance of legal texts regulating urbanization in algeria, but the reality has proven that this phenomenon has not been eliminated and the ineffectiveness of these taken measures in limiting the spread of chaotic buildings.
