الزواج المختلط العرفي على ضوء تقييد المباح - اشتراط اجتهاد المحكمة العليا للرخصة الإدارية المسبقة عند التثبيت أنموذجا-

الملخص
يُحتكم في الزواج المختلط عموما إلى النصوص التنظيمية التي سنتها وزارة الداخلية والجماعات المحلية والتهيئة العمرانية، وذلك بموجب إحالة المادة 31 من قانون الأسرة إليها، إلا أن تلك التنظيمات تتنحى جانبا في حالة ما إذا تم ذلك الزواج عرفيا، أي دون إتباع الإجراءات التنظيمية المتمثلة في وجوب الحصول على رخصة إدارية مسبقة على إبرام الزواج بثلاثة (03) أشهر، وتصير زمام الأمور معلقة بيد القضاء كونه المختص بتثبيت الزواج العرفي عموما. إلا أن قضاء المحاكم والمجالس القضائية عبر ربوع الوطن قد شهد موجة رفض شديدة لتثبيت تلك الزيجات، تأثرا بالموقف الثابت الذي رست عليه المحكمة العليا مطلع سنة 2016 بموجب اجتهاداتها التي أوصدت الباب بإحكام أمام طلبات التثبيت تلك، مما جعل أطراف الزواج المختلط العرفي يضيعون بين رَفْضَيْ الإدارة والقضاء. Abstract: Mixed marriages are generally governed by the regulatory texts enacted by the Ministry of Interior, Local Communities and Urban Development, by referring Article 31 of the Family Law to it. However, these regulations are set aside in the event that the marriage is customary, that is, without following the regulatory procedures represented in the obligation to Obtaining an administrative license three (03) months prior to concluding the marriage, and matters are suspended in the hands of the judiciary, as it is the specialist in establishing customary marriage in general. However, the judiciary of courts and judicial councils across the country witnessed a strong wave of refusal to confirm these marriages, affected by the firm position established by the Supreme Court in early 2016 under its jurisprudence, which closed the door tightly to those applications for confirmation, which made the parties to a customary mixed marriage lost between the administration’s refusal. and judiciary.
