الجنين المشوه وحكم اجهاضه

الملخص
طرح الكلام عن التشوهات الجنينية إشكالا شرعيا وطبيا وخلقيا وقانونيا عويصا، ذلك في ظل التطور الكبير الذي لعبته الاكتشافات الطبية الحديثة فـي مجـال علـم الأجنة، إذ مكنت الأجهزة الطبية الحديثة من رصد تطـور الجنـين فـي رحـم أمـه بـأطواره المختلفـة ، فأصبح بإمكان الطبيب وفي مرحلة باكرة من الحمل الوقوف على الأمراض التي يمكن أن تصيب الجنين وهو في رحم أمه، والجزم بوجود تشوه ما لدى الجنين من الخلل الجسدي أو التخلف العقلي للجنين ، وتشخيص هاته التشوهات الخلقية ، غير أن أساليب العلاج وإصلاح العيوب بقيت محدودة جدا ، مما أثار التساؤل عن حكم إجهاض تلك الأجنة المشوهة قبل ولادتها؟؟. و هـل حدوث تشوه الجنين يغيـر مـن حقيقـة وتكييـف الإجهاض علـى نحـو يـؤثر فـي حكمه؟ legal ,medical, moral and legal forms ,in light of the great development that medical discoveries have played in the field of embryology, as modern medical devices have enabled the monitoring of the development of the fetus in its mother’s womb in its various stages, so that the doctor at an early stages of pregnancy can stand on the diseases that can affect the fetus while it is in the womb of its mother, and the assertion that there is a deformity in the fetus from the physical defect or montal retardation of the fetus, and the diagnosis of these congenital anomalies, however, the methods of treatment and repair of defects remained very limited, which raised the question of the ruling on aborting those deformed fetuses before her birth Does deformation of the fetus change the reality and adaptation of the abortion in a way that affects its judgment
