الملخص
إن استقراء التراث الفقهي النوازلي فيما يتعلق بالاستهلاك وحماية المستهلك، يكشف لنا ما تختزنه أمهات كتب النوازل الفقهية من اجتهادات وتشريعات وأحكام، تمثل ثروة تشريعية ضخمة، هي بمنزلة كنز من كنوز حضارة المسلمين، وسبقا تشريعيا لفقهاء الإسلام لم يقدم أحد للتاريخ مثله قط، كما أن المتابعة الموضوعية والمنصفة لقواعد الحسبة في التاريخ الاقتصادي الإسلامي تطلعنا على المهام الجسيمة التي كان يقوم بها هذا الجهاز، وذلك برقابته الدائمة على المشروعات الإنتاجية في الأسواق، وكيفية تنظيم نشاطاتها الصناعية والتسويقية، زيادة على إنكار المنكرات ومنع الغشوش والخيانة وكتمان العيوب، والحث على اتباع أحسن الطرق الفنية لتحسين مستوى الجودة للسلع والبضائع المنتجة؛ مما يجعله بحق أفضل نظام رقابي لحماية المستهلك وحفظ حقوقه، وقد اهتم الفقهاء بموضوع الاستهلاك اهتماما شموليا، وأحاطوا بأسسه العقدية والخلقية والتشريعية، وعدوه جزءا من النظام الاقتصادي الإسلامي، الذي يجمع بين المقومات المادية والمعنوية، ويقيم التوازن بين المصالح الفردية والجماعية.
