انعقاد الزواج عن طريق الوسائل الإلكترونية الحديثة في ضوء الفقه الإسلامي وقانون الأسرة الجزائري

الملخص
شهدت العقود الأخيرة تحولات مذهلة في مجال وسائل الاتصال الإلكتروني، ومدت جسور التواصل بين الناس بما لم يكن يخطر على البال؛ فدخلت تقنيات التواصل بالصوت والصورة بيوتا كثيرة فضلا عن المؤسسات، مما فتح المجال واسعا لتبادل المعلومات والتجارب وكذا المنافع عن طريق التعاقد الإلكتروني حيث يتجلى التعبير عن الرضا في صورة جلية غاية في الوضوح. ومع ذلك فإن إشكالات وجيهة تطرح في التعاقد الإلكتروني تتعلق بمدى توفر الأمان في مثل هذه الوسائط واستعصائها على الاختراق مما يجعل الشك يتسرب إلى النفوس؛ خاصة في المسائل ذات الخصوصية. وبناء عليه فأهمية هذا البحث تتمثل في كونه نازلة من نوازل العصر، كون عقد الزواج ليس كسائر العقود فهو الميثاق الغليظ. Recent decades have witnessed amazing transformations in the field of electronic means of communication, and the bridges of communication between people have been extended beyond anyone else's mind. Voice and video communication technologies have entered many homes as well as institutions, which has opened the way for the exchange of information and experiences, as well as benefits through electronic contracting, where the expression of satisfaction is manifested in a very clear and very clear way. However, there are serious problems that arise in electronic contracting related to the availability of safety in such media and their impossibility to penetrate, which makes suspicion seep into the souls. Especially in matters of specificity, such as the marriage contract, this latter is not like any other lure, as it is a heavy covenant. Accordingly, in this article we present the issue: “Conducting marriage through modern electronic means in light of Islamic jurisprudence and Algerian family law”. From this study, this study aims to know the opinion of the mujahidin of contemporary Islamic jurisprudence on this issue.
