انعقاد الزواج عن طريق وسائل الاتصال الحديثة بين الشرع الاسلامي وقانون الأسرة الجزائري

الملخص
الملخص: يعد الزواج عقد رضائي بين رجل وامرأة، ينعقد وفق ضوابط شرعية وأطر قانونية، لا يعد الزواج صحيحا إلا بتوافرها، إلا أنه نتيجة للتطور العلمي في وسائل الاتصال الحديثة والذي كان نتيجة للعولمة، أحدث هذا تغير اجتماعي في مواضيع العلاقة الأسرية بما فيها إبرام عقود الزواج، فظهر الزواج الالكتروني الذي يتم عبر وسائل الاتصال الحديثة، فبما أن هذا الموضوع من النوازل الجديدة على المجتمع، والتي هي في انتشار مستمر، نحاول الكشف عن الحكم الشرعي لهذا العقد الالكتروني الحديث، بالرجوع لفتاوى الفقهاء في ذلك، وكذا التكييف القانون بالنظر في مواد قانون الأسرة الجزائري رقم 05/02 المؤرخ في 27 فبراير 2005، وكذا الاطلاع على تجربة الدول العربية الرائدة في إبرام هذه العقود، وأثرها على الاستقرار الأسري. Abstract: Marriage is considered a consensual contract between a man and a woman, which takes place according to Sharia controls and legal frameworks. Marriage is not considered valid except with their availability, except that it is a result of the scientific development in modern means of communication that was a result of globalization. This has brought about a social change in the issues of the family relationship, including the conclusion of marriage contracts, Electronic marriage appeared that takes place through modern means of communication, since this issue is one of the new catastrophes in society, which are in constant spread, we are trying to uncover the legal ruling on this modern electronic contract, by referring to the fatwas of the jurists in this regard, as well as the legal adaptation by considering the articles of the family law Algerian No. 05/02 of February 27, 2005, as well as the experience of the leading Arab countries in concluding these contracts, and their impact on family stability.
