الحماية الدستورية للحق في اللجوء – دراسة مقارنة

الملخص
ملخص: تمثل إشكالية اللاجئين أحد أهم وأكبر التحديات على المستويين الدولي والمحلي كونها تتعلق بأحد أكثر الفئات المستضعفة احتياجًا للحماية. وقد حظيت قضية اللاجئين بعناية واهتمام المجتمع الدولي في أعقاب الحرب العالمية الأولى بحسبانها أحد أهم القضايا المهددة للأمن والسلم الدوليين، إلا أن الزيادة المطردة في أعداد اللاجئين في العقد الأخير، وتردي أوضاعهم الإنسانية والمعيشية دفعت كثيرين إلى التشكيك في جدوى الحماية التي يوفرها التنظيم القانوني الدولي للاجئين حول العالم. ونتيجة لذلك، فقد تعالت الأصوات بضرورة إيجاد بديل آخر لنظام الحماية الدولية، ومن هنا ظهر التفكير في الحماية الدستورية كبديل عن نظام الحماية الدولية، حيث تقع المسئولية الأولى عن حماية اللاجئين ومساعدتهم على عاتق الدول، لاسيما البلدان التي ينزح إليها اللاجئون. وبناء عليه، يعني هذا البحث بتحديد أساس الحماية الدستورية للحق في اللجوء، ومدى جدواها في حماية اللاجئين وتأمين حقوقهم. Abstract: The refugee issue is deemed one of the most important challenges at the national and international levels, as it relates to one of the most vulnerable groups due to the fear and persecution they are exposed to. It is perhaps why this issue has received the attention of the international community in the aftermath of the First World War, as being threatening the international peace and security. Nevertheless, the effectiveness of the international protection for the refugees has been seriously contested over the last years due to the number of refugees and the deterioration of their humanitarian and living conditions. Therefore, serious concerns were raised regarding the need to look up for alternative means to protect the refugees and their rights, and hence arose the constitutional protection as an alternative to the international protection system, given that the main responsibility for protecting and assisting refugees lies within the states jurisdiction. Accordingly, this research aims to identify the legal basis for the constitutional protection of the right to asylum, and its adequacy to protect the refugees and securing their rights.
