الملخص
رصد المشرع الجزائري ضمن المرسوم التشريعي 93-08 المؤرخ في 25 أفريل سنة 1993 المعدل والمتمم للأمر 75-59 المؤرخ في 26 سبتمبر سنة 1975 المتضمن القانون التجاري مادة قانونية تناول من خلالها المبادئ التي تحكم عمليات قانونية مهمة يُقدم عليها خلال مراحل مختلفة من حياة الشركة لاسيما مرحلة الإكتتاب في الأدوات المالية التي تطرحها أثناء مرحلة تأسيسها أو مرحلة الزيادة في رأسمالها والتي ضبطها بالعديد من الشروط من بينها تنازل المساهمين القدامى عن حق الأولوية المخول لهم . The legislator monitored within the Legislative Decree 93-08 of April 25, 1993 amending and completing the order 75-59 of September 26, 1975, which includes the commercial law, a legal article through which it deals with the principles governing important legal processes submitted to it during important stages of the life of the company. especially The underwriting stage of the financial instruments it offers during its incorporation stage or the stage of its increase in its capital, which was set by many conditions, including the assignment by the old shareholders of the priority right they are entitled to.
