الملخص
لم يتفق فقهاء القانون على تعريف موحد للدعوى الإدارية فقد عرفها البعض بأنها سلطة منحها القانون لأي شخص له مصلحة في أن يلجأ إلى قضاء خاص بقصد إلغاء قرار إداري معين أو تحديد مركز قانوني أو حماية حق له، وعرفها البعض بأنها الإجراءات القضائية التي تتخذ أمام القضاء الإداري للمطالبة بأثر من الآثار المترتبة على العلاقة الإدارية. ومن خلال التعريفات المتعددة يمكننا تلخيص تعريف الدعوى الإدارية بأنها السلطة القانونية التي يتمتع بها المظلوم ويتمكن بمقتضاها من اللجوء للقضاء الإداري طالباً حماية حقوقه المعتدى عليها بسبب مباشرة الإدارة لأعمالها القانونية أو المادية أو لتقرير هذه الحقوق أو التعويض عن الأضرار التي تلحق بها، وبالتالي فإن الدعوى الإدارية قد تقام لحماية الحق أو تقريره أو التعويض عن الأضرار التي لحقت بهذا الحق. Legal jurists did not agree on a unified definition of an administrative lawsuit. Some defined it as an authority granted by law to any person who has an interest in resorting to a special judiciary with the intention of canceling a specific administrative decision, determining a legal status or protecting a right to it. Some defined it as judicial procedures that are taken before the administrative judiciary. To claim the effect of the implications of the administrative relationship. Through the various definitions, we can summarize the definition of the administrative lawsuit as the legal authority that the oppressed enjoys and whereby he is able to resort to the administrative court, requesting protection of his infringed rights due to the administration’s conduct of its legal or material work or to determine these rights or compensation for the damages incurred to them, and therefore the administrative lawsuit It may be established to protect or determine the right or to compensate for damages caused to this right.
