التدخل والإدخال في الدعوى الإدارية والشرعية (دراسة تحليلية مقارنة بين القانون الفلسطيني وأحكام الفقه الإسلامي)

الملخص
هدفت الدراسة للتمييز بين التدخل والإدخال في الدعوى الإدارية والشرعية، وبيان أحكامهما، وآثارهما القانونية، وكان تحقيق الهدف من خلال بيان مفهوم التدخل والإدخال ومشروعيتهما، ثم إظهار أهدافهما والفرق بينهما، مع عرض بعض إجراءاتهما في الدعوى الإدارية والشرعية، وللوصول لذلك تم استخدام المنهج الوصفي والتحليلي والمقارن. وقد خلص البحث لمجموعة نتائج من أهمها: رغم أن مبدأ التدخل والإدخال من المبادئ والمسميات المعاصرة والتي لم يعرفها فقهاء المسلمين القدامى بهذا الاسم ولا بغيره من المسميات، إلا أن أصل هذا المبدأ موجود في كتب فقهاء المسلمين. كما يوصي بضرورة تعديل الأصول المطبقة أمام المحاكم الإدارية وتضمينها نصوصاً تتعلق بالتدخل وإدخال الغير في الدعوى الإدارية؛ وذلك لأهمية هذه النصوص في ضبط سير إجراءات التقاضي. Abstract: The study aims to distinguish between intervention and inclusion in the administrative and legal lawsuit, and to clarify their provisions, and their legal effects. The objective is achieved by clarifying the concept of intervention and inclusion and their legality, then showing their objectives and the difference between them, while presenting some of their procedures in the administrative and legal case. To achieve that, the descriptive, analytical and comparative approach is used. The research concludes with a set of results, the most important of which is that despite that the principle of intervention and inclusion is one of the contemporary principles that the ancient Muslim jurists did not know by this name or by any other names, the origin of this principle is found in the books of Muslim jurists. The study also recommends the necessity of amending the rules applied before the administrative courts and inserting in them texts related to intervention and the inclusion of others in the administrative lawsuit; This is due to the importance of these texts in controlling the procedures of litigation.
