فقهاء المغرب و الهجرة الأندلسية بين وجوب الهجرة و رخصة البقاء Maghribi's Jurists And Andalusian Immigration Between Immigration And Permit To Stay

الملخص
أدى سقوط الحواضر الأندلسية تباعا بدءا من سقوط طليطلة(478هـ-1085م) وحتى سقوط غرناطة أخر معقل للسلطة السياسية الإسلامية بالأندلس سنة(897ه-1492م)، إلى تدهور أوضاع مسلمي الأندلس وإلى المآسي والمحن مما أدى إلى نزوح وفرار الكثير منهم إلى مدن المغرب الإسلامي،ولم يبقى إلا فئة لم تستطع الهجرة والفرار إلى العدوة المغربية بسبب ضعفهم أو لأسباب أخرى، جعلتهم يطلبون الفتوى من فقهاء المغرب للنظر في الوضع الذي أصبحوا يعيشونه تحت حكم النصارى، وضع يسوده الاضطهاد والتنصير ومحاكم التحقيق(التفتيش)، فنجد من الفقهاء الذين أجابوا هؤلاء ونظروا في حالهم الفقيهين الونشريسي وأبي جمعة المغراوي ورغم إختلاف أرائهم حول الموضوع، إلأ أنها تبين لنا الاهتمام الذي حضيت به محنة الأندلس من طرف النخبة المغربية ومحاولة مساعدتهم و لو بمدهم بالأحكام الفقهية، التي قد تخفف من معاناتهم وتكون لهم دعما نفسيا في غياب الدعم السياسي من طرف الدول المغربية، ومحاولة للقيام بواجبهم الديني اتجاه إخوانهم الموريسكيين. The fall of the major cities of al-Andalus beginning with Toledo (478/1085) and culminating with Granada (897/1492) led to a tragic deterioration of the conditions of the Muslims there and to their persecution by the conquerors. A large number of Andalusi Muslims fled to various cities in North Africa. Those Muslims who were unable to leave due to various reasons this why they required a legal opinions from the jurists to view the situation they are living under the Christians' rule in which there was the persecution,Christianization and investigation courts. Famous legal scholars such as al-Wansharisi and Abu Jum'a al-Maghrawi responded to these requests, though their opinions differed. Nonetheless, it is clear that the suffering of the Andalusi Muslims received considerable attention from the Maghribi intellectual elite, and attempts were made to assist them by providing them with legal advice that would lessen their sufferings and provide them with psychological support in the absence of effective aid from any North African state. In this way, the North African scholars fulfilled their religious obligation of helping their brethren the Moriscos.
