حكم دفع الزكاة عبر المواقع الإلكترونية – دراسة فقهية معاصرة-

الملخص
إن التطبيقات الإلكترونية خدمة اختيارية، لأفراد المجتمع تمكنهم من دفع زكاتهم إلكترونيًا؛ حيث يسهل دفع الزكاة وإيصالها إلي المستحقين مثل صندوق الزكاة والهيئة العامة للزكاة، من خلال نظام الدفع الإلكتروني. ويهدف البحث عبر اتباع المنهج الوصفي التحليلي إلى بيان حكم دفع الزكاة عبر التطبيقات الإلكترونية في الفقه الإسلامي؛ منعا للعدوى، بأسلوب إلكتروني متطور وبطريقة سهلة، وبطرق دفع آمنة. ولا شك أن التطبيقات الإلكترونية تهدف إلى زيادة الوعي بالزكاة، وترسيخ مفهوم فاعلية الزكاة ودورها الهام في مجال التنمية. وتعمل على إحياء هذه الفريضة تطبيقاً وممارسة؛ لتستفيد منها شرائح المجتمع المحتاجة. وتوصلت إلى العديد من النتائج منها: أن دفع الزكاة عبر صندوق الزكاة هو من قبيل عقد الإجارة وعقد الوكالة؛ يشترط لصحته شروط صحة الإجارة والوكالة. وأن دفع الزكاة عبر صندوق الزكاة والهيئة العامة يجوز بعوض وبدونه قياسا على الوكالة، وأن من القواعد الفقهية المتخرجة على موضوع الدراسة يدفع الضرر العام بتحمل الضرر الخاص، وقاعدة الضرر يزال. وأوصي بتطبيق شرع الله تعالى والوقوف على حكمه في القضايا المستجدة، والعناية بنشر الضوابط الشرعية التي تحكم جواز دفع الزكاة عبر المواقع الإلكترونية. الكلمات المفتاحية: الهيئة العامة للزكاة؛ التطبيقات؛ صندوق الزكاة؛ دفع الزكاة. Abstract Search title: The legality of paying zakat via websites Contemporary Jurisprudence Study The electronic applications are an optional service for community members that enables them to pay their zakat online. The research aims, by following the descriptive and analytical approach, to explain the ruling on paying zakat via electronic applications in Islamic jurisprudence. To prevent infection, using an advanced electronic method, an easy way, and safe payment methods. There is no doubt that electronic applications aim to increase awareness of Zakat, and to consolidate the concept of the effectiveness of Zakat and its important role in the field of development. And it works to revive this duty in application and practice; To benefit from the needy segments of society. And I reached many results, including: Paying zakat through the Zakat Fund is a kind of leasing contract and a contract of agency. For his validity, conditions for validity of the lease and agency And that the payment of zakat through the Zakat Fund and the Public Authority is permissible with compensation and without it, by analogy with the agency, and that one of the jurisprudential rules that graduated on the subject of study pays the general harm by bearing the special harm, and the rule of harm is removed.
