ضمانات تكوين الجمعيات في الدول المغاربية تونس نموذجا

الملخص
أورد المشرع التونسي ضمانات متعددة لتكريس حق الأفراد في تكوين الجمعيات ، وقد اختلفت هذه الضمانات بحسب طبيعة التوجه السياسي للنظام الحاكم ،فقد عرفت الفترة التي تلت الاستقلال إلى غاية قبيل قيام الثورة سنة 2011 تضييقا كبيرا على الحق في تأسيس الجمعيات ، وبعد قيام الثورة شهد الحق في تأسيس الجمعيات تطورا كبيرا مقارنة بالفترة السابقة لها ، وقد تم التعرض إليها وفقا لما ورد من ضمانات دستورية وقانونية وقضائية في مرحلة ما قبل الثورة وبعدها . The Tunisian legislator included several guarantees to enshrine the right of individuals to establish associations. These guarantees differed according to the nature of the political orientation of the ruling regime, as the period following independence until the time before the revolution in 2011 was subjected to severe restrictions on the right to establish associations. After the revolution, the right to establish associations witnessed a significant development compared to the previous period according to the constitutional, legal and judicial guarantees stated in the pre-revolution and after the period that they were subjected to.
