الهيمنة الحكومية على قانون الدوائر الانتخابية البرلمانية

الملخص
ملخص : تنظم الدوائر الانتخابية في الانتخابات البرلمانية المتمثلة في انتخابات المجلس الشعبي الوطني وانتخابات ثلثي أعضاء مجلس الأمة بموجب قانون عادي، ومن المفروض أن يختص البرلمان بإعداد قانون تحديد الدوائر الانتخابية البرلمانية إلا أن التعديل الدستوري لسنة 2020 الذي يحدد نوعية تطبيق مبدأ الفصل بين السلطات في ظل مبدأ التوازن بين السلطات والقانون رقم 16-12 الذي ينظم العلاقة الوظيفية بين البرلمان والحكومة يؤكدا على تفوق الحكومة في اعداد قانون تحديد الدوائر الانتخابية البرلمانية من حيث المبادرة بمشروع القانون وترتيبه في جدول أعمال البرلمان وكذا في الاجراءات التشريعية التي يمر بها مشروع القانون إلى غاية اصداره. Abstract: Electoral districts in the parliamentary elections, including the elections of the People’s National Assembly and two-thirds of the Council of the Nation members, are organized according to ordinary law. The Parliament is supposed to be dedicated to preparing the electoral district Act defining these elections. However, the 2020 constitutional amendment, which determines the quality of applying the principle of separation of powers under the principle of balance of powers, and Act No. 16-12, which regulates the functional relationship between parliament and the government, emphasize the government’ excellence in the preparation of the act on the establishment of parliamentary constituencies in terms of initiating and arranging the draft law on the parliament’s agenda, as well as the legislative procedures in which the draft law goes through.
