المؤثرات العقلية بين القصور التشريعي والإباحة الطبية - عقار(بريغابالين) نموذجا – Psychotropic Substances Legislative Deficiency And Medical Permissibility- Pregabalin As A Model-

الملخص

الملخص: تعد ظاهرة استهلاك المؤثرات العقلية إحدى الظواهر الخطيرة التي تهدد الفرد والمجتمع على حد سواء في جميع الميادين الصحية (النفسية) والاجتماعية والاقتصادية. حيث أصبح مواجهة هذه الظاهرة بالعقوبة التقليدية وحدها غير كافي. هذا من جانب، أما الجانب الثاني فهو إشكالية التضارب بين وجود إباحة طبية تجيز استعمال هذه المواد في حالات معينة مقابل تجريم قانوني يتصادم مع هذه الإباحة . وعليه ارتأينا معالجة هذه الإشكالية وفق المنهجين الوصفي والتحليلي حيث نصف الظاهرة وانتشارها، ثم نحلل أهم العوامل والنصوص القانونية ذات الصلة، ولعل من أهم النتائج المتوصل إليها هو ثبوت قصور النصوص القانونية الحالية وعدم فاعلية العقوبة لهذه الظاهرة الخطيرة، و ازدياد انتشار العقاقير والأدوية والمواد غير المراقبة، وضرورة إيجاد وسائل بديلة لا تنفي العقوبة تماما وإنما تكمل نقائصها . Abstract: The phenomenon of consumption of psychotropic substances is one of the dangerous phenomena that threaten both the individual and society in all health (psychological), social and economic fields. Where confronting this phenomenon with conventional punishment alone has become insufficient. This is on the one hand, and the second aspect is the problem of conflict between the existence of a medical legalization that allows the use of these substances in certain cases in exchange for legal criminalization that collides with this legalization. Accordingly, we decided to address this problem according to the descriptive and analytical approaches, where we describe the phenomenon and its spread, and then analyze the most important factors and relevant legal texts. And the need to find alternative means does not completely negate the penalty, but rather complements its shortcomings.
