الحق في إسترجاع العقارات المنتزعة في التشريعين التونسي والجزائري

الملخص
حتى يتم تكريس الحماية اللازمة لحق الملكية الذي دعت إليه المواثيق الدولية والتشريعات الداخلية للدول، إعترف المشرع في كل من الجزائر وتونس بمجموعة من الضمانات للمالك، كحقه في إسترجاع العقار إذا تم إنتزاعه منه بغرض تحقيق المصلحة العامة وتقاعست الجهة المستفيدة عن إقامة المشروع الذي تعهدت بإنجازه خلال المدة المحددة قانونيا. غير أن التمتع بهذا الحق لايتم إلا في ظل توافر شروط معينة تم النص عليها في القوانين والتنظيمات المعمول بها في كل من تونس والجزائر، وهوما يفرض التقيد بإجراءات معينة عند ممارسة هذا الحق خاصة وأنه يعد الفرصة الأخيرة التي يستطيع من خلالها منزوع الملكية إستعادة عقاره المنزوع. ومن أجل ذلك تم التطرق في هذه الورقة البحثية إلى الحق في إسترجاع العقارات المنتزعة في كل من تونس والجزائر وتوضيح مواطن الإختلاف بينهما. In order to devote the necessary protection to the right of property called for by international charters and internal legislation of countries, the legislator in Algeria and Tunisia recognized a set of guarantees for the owner, such as his right to recover the property if it was expropriated from him for the purpose of achieving the public interest, and the beneficiary failed to establish the project that it pledged to complete. within the legally specified period. However, the enjoyment of this right is only in light of the availability of certain conditions stipulated in the laws and regulations in force in Tunisia and Algeria, which imposes adherence to certain procedures must be adhered to when exercising this right, especially since it is the last opportunity which the the owner can recover his expropriated property. And for that, the right to recover the expropriated real estate in Tunisia and Algeria was discussed in this research paper and clarified the differences between them.
