حماية حق المؤلف رقميا في إطار المعاهدات الدولية ذات الصلة

الملخص
الملخص: تجلت الجهود الدولية لحماية حق المؤلف، في ابرام اتفاقيات تكفل حد ضروريا من الحماية، غير ان التطور المتسارع للإبداع البشري، وانتشاره كونيا عن طريق الربط بالشبكة العنكبوتية، جعل تلك المعاهدات قاصرة عن مجاراة ذلك النسق، فاتفاقية بيرن، ورغم التعديلات اللاحقة لها، لم تكن كافية، مما ادى الى ابرام اتفاقية تريبس، ثم اتفاقية الويبو بشان حق المؤلف لسنة 1996، التي تعتبر اول معاهدة اثارت اشكالات الابداع على المستوى ارقمي، وهو ما ستحاول الورقة البحثية اثارته من خلال تبيان الضوابط القانونية الدولية الكافلة لحماية حق المؤلف رقميا. Abstract International efforts to protect copyright were manifested in the conclusion of agreements that guarantee a necessary level of protection. However, the rapid development of human creativity, and its global spread through the Internet, made those treaties insufficient to keep pace with that pattern. The Berne Convention, despite its subsequent amendments, was not Sufficient, which led to the conclusion of the TRIPS Agreement, and then the WIPO Copyright Agreement of 1996, which is considered the first treaty that raised the problems of creativity at the digital level, which the research paper will try to raise by clarifying the international legal controls that guarantee the protection of copyright digitally.
