الملخص
باعتبار أن عقود تفويض المرافق العامة ذات طبيعة إدارية فإن تنفيذها يخضع لأحكام القانون العام كسائر العقود الإدارية الأخرى، فترتب آثارها تجاه أطراف العلاقة العقدية سواء الإدارة المفوضة أو المفوض له أثناء تنفيذ عقد التفويض حيث يتولى المفوض له استغلال المرفق العام بذاته وعلى مسؤوليته، حيث يتمتع بمجموعة من الحقوق، لا يشاركه فيها غيره من المتعاقدين مع الإدارة المفوضة ومن أهم هذه الحقوق تقاضي مقابل مالي من المستفيدين من المرفق إلى جانب تمتعه ببعض الامتيازات في تسير المرفق، وهذه الحقوق بدورها تقابلها التزامات مختلفة ومتنوعة تقع على عاتقه من أهمها التنفيذ الشخصي للعقد، ومع هذا فإن هذه الحقوق وتلك الالتزامات تتميز إلى حد كبير في عقود التفويض عنها في العقود الإدارية الأخرى، وذلك بالنظر إلى مضمون هذه العقود المتمثل بإدارة واستثمار المرفق العام. Considering that public utilities delegation contracts are of an administrative nature, their implementation is subject to the provisions of the common law like all other administrative contracts, and its effects are directed towards the parties to the contractual relationship, whether the delegated administration or delegated to him during the implementation of the delegation contract, where the delegate takes over the exploitation of the public facility itself and on its responsibility, as it enjoys a group Of the rights, which are not shared by other contractors with the delegated administration, and one of the most important of these rights is to receive financial compensation from the beneficiaries of the facility, in addition to enjoying some privileges in running the facility, and these rights in turn are offset by various and varied obligations that fall upon him, the most important of which is the personal implementation of the contract, and with this These rights and obligations are distinguished to a large extent in delegation contracts from other administrative contracts,given the content of these contracts represented in the management and investment of the public utility.
