حماية المرأة من جميع أشكال العنف بين الشريعة والقانون

الملخص
العنف ضد المرأة كظاهرة ليست وليدة العصر الحديث، بل قديمة ضاربة في جذور التاريخ البشري قدم البشرية، برزت كإحدى التحديات الكبرى التي تحتاج إلى مواجهة صارمة لما لها من تأثير خطير على حياة المرأة و تهدد تواجدها الإنساني بتزايد وتنوع أنماط العنف ضدها نتيجة التطورات، خاصة التطور التكنولوجي الرهيب في وسائل الاتصال وتأثيرها السلبي على العلاقات الإنسانية، حيث أصبحت قضية العنف والسلوك العدواني ضد المرأة في السنوات الأخيرة أكثر انتشارا ووحشية، إذ لم يتوقف عند العقاب أو الإيذاء الجسدي الذي يسبب الأضرار المادية، التي تظهر نتائجها على جسم المرأة المعنفة، بل يتعداه إلى السب والشتم والإهانات ومحاولات إخافتها، وعزلها، والتحكّم بها، وقد يتبع ذلك بالعنف العاطفي والهجر، بغرض التأديب والسيطرة عليها جسديا، معنويا وماديا، والإنقاص من قيمتها كشخص فعال في المجتمع، الأمر الذي يولد اهتزازا في نمط الشخصية عند المرأة، يؤدي في النهاية على المدى البعيد إلى خلق أشكال مشوهة من العلاقات والسلوك وأنماط من الشخصية المتصدعة نفسيا وعصبيا التي تكون لها نتائج سلبية على البناء الأسري والاجتماعي ككل بفرض أن المرأة تمثل نصف المجتمع وصلاحها يؤدي إلى صلاحه، وعليه كان ولابد من التفكير في إيجاد سبل كفيلة لحماية هذا الكائن، تنوعت هذه الأخيرة بين الشريعة الإسلامية والقوانين الوضعية بين دولية ووطنية ودائما من أجل النهوض بسلامة المرأة جسديا ومعنويا. Abstract: Violence against women as phenomenon is not a product of the modern era, but rather an ancient one rooted in the roots of human history as old as humanity, it has emerged as one of the major challenges that needs to be faced strictly because of its serious impact on her life and the threat of her human presence with increasing and diversifying patterns of violence against it, as a result of developments, especially in the scary technological field in the means of communication and its negative impact on human relations, where the issue of violence and aggressive behaviour against women in recent years has become more brutal and widespread as it did not stop at the punishment or physical abuse that causes material damage, the results of which appear on the body of the battered woman, but rather go to insults, and attempts to intimidate her, isolate and control her, This may be followed by emotional violence and abandonment, for the purpose of disciplining and controlling it physically, morally and financially, and reducing its value as an effective person in society, Which creates a shake in the woman’s personality style, which ultimately leads in the long run to creating distorted forms of relationships and behaviour and patterns of psychologically and nervous personality that have negative consequences for the family and social construction as a whole by assuming that women represent half of society and its goodness leads to the goodness of society, it was necessary to think about finding ways to protect this being. The latter varied between Islamic law and statutory laws, whether international or national, and always for the advancement of women's physical and moral integrity.
