أحكام فقهية و قانونية في التبرع بالأعضاء بين المسلمين و غيرهم

الملخص
خلق الله عز وجل الناس ذكورا وإناثا وجعلهم شعوبا وقبائل مختلفة، وأرسل إليهم الرسل عليهم الصلاة والسلام، فبينوا لهم الحق من الباطل وهذا من تكريم الله تعالى لبني آدم، وميز بين الناس جميعا بأمر واحد وهو التقوى قال تعالى: ((إن أكرمكم عند الله أتقاكم )) [ الحجرات / 13 ] لذا وُجِد المسلم والكافر إلا أن هذا التفريق لم يمنع المعاملات بينهما، مثل الجوار والبيع والشراء والاستثمار والتبرع، هذا الأخير أخذ حيزا مُهِمًّا في هذا العصر الحديث، خاصة الجانب الطبي منه وهو التبرع بالأعضاء البشرية، والمعروف أن الله كّرَّم الانسان وجعل لجسده حرمة تمنع من التصرف فيه، إلا طبقا لما جاء في الشرع، والذي يراعي هنا باب المصالح والمفاسد التي تحدد من خلال اجتهاد العلماء والمجتهدين، ومن القضايا التي كثر الأخذ والرد فيها قضية التبرع بالأعضاء لغير المسلم. God Almighty has created people as males and females and made them different peoples and different tribes. Then, he sent to them prophets May peace and blessings be upon them where they showed them what is right and what is wrong; and this is from the honour of God almighty to human beings. God almighty distinguishes between his creatures by only one thing which is altakwa. Allah said: ‘’إن أكرمكم عند الله أتقاكم’’ (الحجرات 13) . That’s why we find the Muslim and the non-believer, but this distinction did not prevent transactions between them in the different domains of life like neighbourhood, commerce -except in what is forbidden in the Islamic religion-, investment and donation. This latter took an important space in the modern era especially in the medical side like human organs donation. What is known is that God almighty honoured the human being and made sanctity for his body which forbade us from the disposal in it –except in what corresponds with the Islamic religion-. And here it takes into consideration virtues and vices that are determined by scholars and specialized people. From the issues that took a lot of interest and attention is the issue of organs donation to non-Muslims.
