المعالجة الجزائية لظاهرة الرشوة في القطاع العام في ظل قانون مكافحة الفساد

الملخص
إن المصلحة القانونية المهدورة بارتكاب جريمة الرشوة هي حسن أداء الوظيفة العامة،فالرشوة مدخل لفساد موظفي الدولة تؤدي إلى إثرائهم دون سبب مشروع ،بينما الأصل أنهم ملزمون بأداء الخدمات للمواطنين دون مقابل،وهنا تكمن الخطورة إذ تصبح الوظيفة العامة سلعة يتاجر بها وتلك مقدمات الفساد التي تصيب وظائف الدولة الأخرى فالمشرع أولى هذه الجريمة الصرامة من ناحية تجريم وقمع كل إخلال بواجب النزاهة الذي يستوجب على الموظف العمومي أن يتحلى به وكل إخلال بواجبات الأمانة الملقاة على عاتقه حيث وسع في القانون 06/01 المتعلق بمكافحة الفساد و الوقاية منه نطاق الجريمة فلا تقتصر على الموظف العمومي وحده ،بل تمتد إلى كل الأشخاص الذين يقدمون خدمة عامة بل وحتى الأشخاص الذين يقومون بخدمة خاصة ،فضلا عن فئة الموظفين العموميين الأجانب وموظفي المنظمات الدولية العمومية. الكلمات المفتاحية :مكافحة الفساد ،جريمة الرشوة ،المعالجة الجزائية ،الموظف العمومي، المصلحة العامة . Summary: The wasted legal interest in committing the crime of bribery is good performance of the public job. Bribery is an entry point for corruption of state employees, which leads to their enrichment without a legitimate reason, while the original principle is that they are obliged to perform services to citizens without compensation, and here the risk lies as the public job becomes a commodity to trade with and those introductions of corruption Which affects the functions of the other country, the legislator prioritizes this crime, in terms of criminalization and suppression of any breach of the duty of integrity that requires the public official, To have it and every breach of the duty of integrity that the public official must fulfill and every breach of the duties of the trust placed upon him, as he expanded in Law 1/6 related to fighting corruption and its prevention, from the scope of the crime, so it is not limited to the public employee alone, which does not extend to All the people who provide public service and even the people who perform the special service, as well as the category of foreign public officials and public international organizations.
