حالة الضرورة المقيدة للحصانة الدبلوماسية

الملخص
يتمتع المبعوث الدبلوماسي بعديد من الحصانات والامتيازات الدبلوماسية التي كفلتها له العديد من الاتفاقيات الدولية وكذا القوانين الداخلية وذلك من اجل ممارسة مهامه المنوط به على وجه تام، فالحصانة الدبلوماسية للمبعوث الدبلوماسي هي من القواعد التي لا يجوز مخالفتها أو الإخلال بها، غير أنه في حالة تجاوز المبعوث الدبلوماسي حدود حصانته من خلال ارتكابه أعمالا مهددة لمصالح أساسية للدولة المعتمد لديها بسبب تلك الحصانة خاصة إذا تعلق الأمر بتهديد مصلحة عليا للدولة الموفد إليها جاز لتلك الدولة فرض رقابة وتقييد لتلك الحصانة المهددة لأمنها وسيادتها وحماية مصالحها الأساسية وذلك تحت دافع الضرورة مع مراعاة عدم التعسف في استعمال هذا الحق من خلال احترام قواعد القانون الدولي وفق ضوابط وشروط معينة في هذا المجال .^ The diplomatic envoy shall enjoy many diplomatic immunities and privileges guaranteed to him by many international conventions as well as domestic laws in order to fully exercise his functions. Diplomatic immunity of the diplomatic envoy shall be a norm which cannot be violated or violated. However, if the diplomatic envoy exceeds his immunity limits by committing acts that threaten the fundamental interests of the State of which he is accredited because of that immunity, especially when it comes to a threat to the supreme interest of the sending State, that State may impose a control and restrict that immunity, which is threatened by its security and sovereignty and protect its fundamental interests, under the will of necessity Taking into account the non-abuse of this right by respecting the rules of international law in accordance with certain disciplines and conditions in this field.
