تخريج الفروع على الأصول في فقه الإمام ابن حزم بناء على مراعاة المقاصد النصية للشريعة الإسلامية

الملخص
الملخص: تهدف هذه الدراسة إلى إبطال ما شاع عن الإمام ابن حزم الأندلسي رحمه الله تعالى في كونه لا يعتبر المقاصد الشرعية في فقهه وفتاواه واجتهاداته، وأنّه عرف عنه التمسك بظواهر النصوص والوقوف على حرفيتها دون الالتفات إلى روح النصوص و معانيها على حد تعبير علماء مقاصد الشريعة الإسلامية، ولعلّ مبنى هذا الرأي وعمدته على نفي الإمام ابن حزم لدليل القياس وعدم اعتباره أصلا من أصول الشريعة الإسلامية التي تبنى عليها الأحكام الفقهية وتخرج عليها الفروع . وإنّ المدقق لفقه الإمام ابن حزم رحمه الله تعالى والناظر بعين البصيرة والعدل في مؤلفاته وتراثه يجد أنه رحمه الله تعالى على خلاف ما يقولون وما يعتقدون، وهذا ما سنحاول الوقوف عليه في هذه الدراسة. Abstract: This study aims to nullify what was rumored about Imam Ibn Hazm al-Andalusi, may God have mercy on him, in that he did not consider the legitimate purposes in his jurisprudence, fatwas and jurisprudence, and that he was known to adhere to the phenomena of texts and stand on their literalism without paying attention to the spirit of the texts and their meanings, according to the expression of scholars of the purposes of Islamic law. Perhaps this opinion is based and based on Imam Ibn Hazm’s denial of the analogy evidence and not considering it as one of the foundations of Islamic Sharia on which jurisprudential rulings are based and branches are extracted from. And the one who examines the jurisprudence of Imam Ibn Hazm, may God Almighty have mercy on him, and the one who looks with insight and justice in his writings and heritage will find that he, may God Almighty have mercy on him, is contrary to what they say and what they believe, and this is what we will try to stand on in this study.
