الحماية الجنائية لسرية الاتصالات الإلكترونية والقيود الواردة عليها دراسة تحليلية مقارنة بين التشريع الجزائري، القطري والفرنسي

الملخص
ملخص: تناولت الورقة البحثية بالدراسة التحليلية والمقارنة حق الأفراد في ممارسة حياتهم الخاصة بكل حرية والاحتفاظ بكل ما يتعلق بعناصرها، حيث يعتبر هذا الحق طبيعة إنسانية أقره الوجود البشري، و من بين المظاهر التي يتضمنها هذا الحق سرية المراسلات والاتصالات؛ فحاولنا من خلال عملية البحث توضيح المقصود بالحياة الخاصة والاتصالات الإلكترونية، غير أن هذا الحق كغيره من الحقوق معرض للانتهاك والاعتداء، مما جعل المشرع الجزائري يضمن حمايته محققا بذلك الهدف من وجود سياسته الجنائية وتكريسا للمبادئ التي حملتها مختلف الصكوك والاتفاقيات الدولية؛ سواء عبر النصوص الدستورية أو التشريع العادي والقوانين الخاصة وحتى القوانين المكملة مقارنة ببعض القوانين الغربية والعربية، غير أن هذه الحماية يمكن تقييدها وتجاوزها لكن في حدود ما يسمح به القانون. الكلمات المفتاحية: الحماية الجنائية، السرية، الاتصالات الإلكترونية، حرية الحياة الخاصة، سرية الاتصالات. Abstract: This research paper focused on the analytical and comparative study of the right of individuals to exercise their inviolability of private life and to perserve everything ralated to its elements, since this right is considerd as a human nature recognazed by human existence ,and among the manifestation included in this right is the secrecy of corespondence and commuinication ,so we have clarify what is meant by privacy and electronic communication ،however this right like other rights is susceptible to infringement, which maded the algerian legislator guarantee his protection in order to reach the objective of its criminal policy and in compliance with the principles contained in Different international instruments and agreements whether hrough contitutional law or ordinary laws and private laws, complementary laws compared to some Foreign and arabic laws, but this protection can be limited within the limits stipulated by law.
