الملخص
يعتبر حق حرية المعتقد من الحقوق اللصيقة بالإنسان تربطه ارتباطا وثيقا مع باقي الحريات الأخرى سواء منها الفردية أو الجماعية، وتعد ممارسة الشعائر الدينية الجانب العملي لحرية المعتقد، وانطلاقا من هنا فإن المواثيق الدولية والاتفاقيات الأممية والإقليمية قد كرست هذا الحق واهتمت به وضمنته، كما نجد جل الدساتير العالمية ضمنت هذا الحق في طياتها، وانطلاق من كون الجزائر عضو في المجتمع الدولي تتفاعل معه وتؤثر وتتأثر به فإنها كرست هذا الحق في دساتيرها المتعاقبة وقوانينها الداخلية بغية الوفاء بالتزاماتها الدولية التي تعهدت بها. يصنف الدستور الجزائري حرية المعتقد وممارسة لشعائر الدينية ضمن الحقوق الأساسية للمواطن شريطة أن يمارس هذا الحق في إطار القانون، كما يكفل التشريع الوطني لكل معتنقي الأديان عدم التعرض والاعتداء عليهم بموجب قانون العقوبات والنصوص الخاصة المكملة له. The right to freedom of belief is considered one of the rights that are closely related to the human being, and it is closely linked with other freedoms, whether individual or collective, and the practice of religious rites is the practical aspect of freedom of belief. World constitutions have guaranteed this right in its folds, and based on the fact that Algeria is a member of the international community that interacts with, influences and is affected by it, it has enshrined this right in its successive constitutions and internal laws in order to fulfill its international obligations it has undertaken. The Algerian constitution classifies the freedom of belief and the practice of religious rites among the basic rights of the citizen, provided that he exercises this right within the framework of the law. National legislation guarantees that all religious believers are not subjected to abuse under the Penal Code and its complementary texts.
