الإطار القانوني لحماية العمال الأجانب على مستوى منظمة العمل العربية

الملخص
تهدف هذه الورقة البحثية الى التعرف على المنظومة التشريعية المتعلقة بالعمال الأجانب التي اقرتها منظمة العمل العربية وذلك في حصر هذه الشريحة من العمال في ثلاثة اتفاقيات رئيسية، الاتفاقية رقم(2) بشأن تنقل الايدي العاملة عام 1967والاتفاقية العربية رقم (4) بشأن تنقل الايدي العاملة(معدلة) عام 1975 والاتفاقية العربية رقم(14) بشأن حق العامل العربي في التأمينات الاجتماعية عند تنقله للعمل في أحد الأقطار العربية عام 1981، فرغم أهمية هذه الاتفاقيات التي كرست جملة من الاحكام وتبنيها مبدا الاولوية للعمال العرب على حساب العمال الاجانب الا انها قوبلت بضالة عدد التصديقات لكثير من الدول الأعضاء. وقد اعتمدنا في دراستنا على المنهج التحليلي الذي يلائم هذه الدراسة، من خلال الوصول الى تحليل شامل لنصوص هذه الاتفاقيات التي تنظم عمل الأجانب وابراز أهميتها ودورها في تكريس الحماية الفعالة لهذه الشريحة. حيث توصلنا الى ضرورة تفعيل الاتفاقيات الخاصة بتنقل الايدي العاملة (الجماعية والثنائية) من خلال التصديق عليها واعطاءها الصبغة الإلزامية، وخلق الاليات لمتابعة تطبيق احكام هذه الاتفاقيات من اجل الوصول الى تحقيق الوحدة الشاملة للوطن العربي في المجالين الاجتماعي والاقتصادي، مع تبني سياسة مشتركة بين الدول العربية لإحلال العمالة الوطنية والعربية. كلمات مفتاحية: العمال الأجانب، منظمة العمل العربية، الاتفاقيات الجماعية، تنقل العمال. Abstract: This research paper aims to identify the legislative system concerning foreign workers approved by the Arab Labor Organization, in limiting this segment of workers to three main conventions, Convention No. 2 on labor mobility in 1967, Arab Convention No. 4 on labor mobility in 1975, and Arab Convention No. 14 on the right of Arab workers to social insurance when they move to one of the Arab countries in 1981. Despite the importance of these agreements, which have devoted a number of provisions and adopted the principle of priority for Arab workers at the expense of foreign workers, they have received a lot of ratifications from the member states. In our study, we relied on the analytical approach that fits into this study, through a comprehensive analysis of the texts of these conventions, which govern the work of foreigners and highlight their importance and role in establishing effective protection for this segment. We have found it necessary to activate the agreements on labor movement (both collective and bilateral) by ratifying them and creating mechanisms to follow up on the implementation of the provisions of these agreements in order to achieve comprehensive unity of the Arab world in the social and economic fields, while adopting a joint policy among Arab countries to establish national and Arab labor. keywords: Foreign workers, the Arab Labor Organization, collective agreements, labor mobility
