Le Principe De Liberté D'investir Selon La Législation Algérienne

Résumé : Depuis les années 2000, les politiques algériennes de l’investissement d’une manière générale, et le principe de liberté d’investir plus précisément, ont oscillé entre ouverture confiante, méfiance et réouverture vigilante. Mais au tournant des années 2020, l’Algérie a tenté un retour vers une plus grande ouverture conformément à ses choix de libération des échanges, une procédure qui s’inscrit dans un contexte qui se caractérise par une prolifération des traités sur la promotion et la protection des investissements. Néanmoins, l’adoption d’une politique très ouverte à l’égard des investisseurs étrangers risque de faire perdre à l’Etat son droit légitime de contrôle et de réglementation sur les installations des investissements étrangers (IDE) sur son territoire. Il est donc dans l’intérêt de l’Algérie d’adopter un système juridique qui réglemente le principe de libre investir et le garantit pour ses investisseurs (étrangers ou nationaux), mais sans pour autant perdre son droit de contrôle sur son territoire national. Abstract: Since 2000s, generally, Algerian investment policies and, more precisely, the principle of freedom to invest they oscillated between confident openness, mistrust, and vigilant reopening. But at the turn of 2020, Algeria attempted a return to greater openness in accordance with its choice of trade liberalization, a procedure that fits into a context, which is characterized by a proliferation of treaties, on the promotion, and the protection of investments. However, the adoption of a very open policy towards foreign investors risks causing the State to lose its legitimate right to control and regulate foreign investment facilities (FDI) on its territory. It is, therefore, in Algeria’s interest to adopt a legal system that regulates the principle of free investment and guarantees it for its investors (foreign or national), but without losing its right of control over its national territory.
