الملخص

سعت الشعوب وعبر مختلف العصور إلى تنمية مجتمعاتها، و ذلك بحماية مقومات وجودها من أعراف و تقاليد و عادات تنظم بها حياتها وتضمن استمراريتها، اذ تعد هذه المقومات موروثا ثقافيا في مسيرة وجودها، ومن أجل تحقيق ذلك استعانت الشعوب بجملة من الأفكار الفلسفية و القانونية تستطيع من خلالها بعث مبادئ وأسس نهضتها وبقائها وتحمي من خلالها عناصر وجودها، ومن بين هذه الأفكار فكرة النظام العام العمراني و المتمثل في كيفية تنظيم عمرانها الذي يشهد على حضارتها و ثقافتها ، لكن رغم عمومية الفكرة وتجريدها تبقى الوسيلة الوحيدة التي يمكن للدولة من خلالها بث القيم والأصول التي تؤمن بها الجماعة في شكل قواعد قانونية آمرة وقسرية لا يمكن للفرد سوى التقيد والالتزام بأحكامها باعتبارها وسيلة قانونية توفر للدولة أكبر قدر ممكن من الانصياع والقبول الذاتي و الطوعي لتشريعاتها العمرانية. Abstract: Throughout humanity, peoples and ages have strived to develop their societies and to protect the foundations of their existence and the various customs, traditions and customs which organize their life and guarantee their continuity, because these foundations are a cultural heritage on the path of their existence. And to achieve this, she sought the help of a set of philosophical or legal ideas through which she can send principles and foundations for her ascension and survival and protect the elements of her existence. Among these ideas is the idea of urban public order. This, despite its generality and abstraction, remains the only means by which the state can transmit the values and assets in which the group believes in the form of legal rules to which the individual can only adhere and respect its provisions as as a legal means which provides the State with the highest degree of compliance and self-acceptance and voluntary of its urban legislation.
