الملخص
لأغراض تتعلق بضرورة احترام الممارسة الحقوقية لفئة المهاجرين واللاجئين في مواجهة التحديات غير المسبوقة التي تفرزها الأوضاع الاستثنائية الناجمة عن التداعيات والانعكاسات السلبية لجائحة كوفيد 19، كان لابد من تحديد الأبعاد الحقوقية في الاستجابة لهذه الجائحة ، وإن هذه المسألة تطرح إشكالية مضمونها مدى تحقيق الدول لسياسة التوافق بين الالتزامات المترتبة على عاتقها انطلاقا من واجب حماية الصحة العامة، والتزامها بضمان الممارسة الحقوقية لفئة المهاجرين واللاجئين، الأمر الذي يبرز ضرورة تنمية القيم المتعلقة بالمسؤولية في إطار الوعي الفكري التضامني الإنساني من خلال عولمة المخاطر والتداعيات تجسيدا لفكرة المصالحة بين مقتضيات الأمن الصحي ومتطلبات الحفاظ على حقوق المهاجرين واللاجئين وفق مبادئ التناسب و الملائمة ،الضرورة و الظرفية . For the necessity of respecting the human rights practice of migrants and refugees in the face of the unprecedented challenges posed by the exceptional situations resulting from the negative repercussions and repercussions of the Covid-19 pandemic, it was necessary to define the human rights dimensions in responding to this pandemic, Which pose a problematic about the extent to which states have achieved the policy of consensus between The obligations arising from the obligation to protect public health, and its commitment to ensuring the human rights practice of the migrants and refugees , which highlights the need to develop values related to responsibility within the framework of intellectual solidarity awareness of humanity through the globalization of risks and repercussions as an embodiment of the idea of reconciliation between the requirements of health security and of preserving the rights orequirement and the refugees according to the principles of proportionality and appropriateness, necessity and circumstance.
