الوظيفة المقاصدية ومسالكها في فهم السنة النبوية

الملخص
ملخص: لا يزال الدرس الـمقاصدي يثير إشكالات وتساؤلات متجددة في كل عصر ومكان، وعند جميع العلماء على تنوع تخصصاتهم، واختلاف مناهجهم، بما كان له أثر في توسيع أو تحجيم دور الـمقاصد في استنباط الأحكام، وكان الغرض من هذه الـورقة العلمية سلوك أوسط الطرق وأيسر السبل في الجمع بين محاسن الأقوال وإظهار أوجه العلاقة بينها، لندرك جذور الوظيفة الـمقاصدية وعروقها التي تمتص من الجهات المختلفة، فتنظم مسائلها في سلك واحد ينفي عنها الاختلاف والتناقض. وقد خلص البحث إلى أن الوظيفة الـمقاصدية منهج كلي متكامل تؤهِّـل الفقيه إلى وضع النصوص النبوية في سياقها الصحيح في مختلف القضايا الواقعة، وأنّ حضورها أمر لازم في ذهن الـمتفقهين في الحديث الشريف؛ حتى لا يساء العمل بالسنة في غير ما شُرِعت له، فيترتب على ذلك تـهميش الفقه أمام متطلبات الحياة الـحديثة ! Abstract: The Sharia Objectives lesson still excites new problems and questions in every time and place, and for all scholars with different specialities and different methods, which had the effect of expanding or scaling the role of the objectives in elicitation rulings, and the purpose of this scientific paper was to follow the middle and the easiest way to gather the merits of opinions and showing the aspects of the relationship between them, so that we realize the roots of the objectives evaluation and their veins that is absorbed from the different places, so that its issues are organized in one way that remove the disagreement and contradiction. The research concluded that the the objectives evaluation is a holistic and integrated approach that qualifies the jurist to place the prophetic texts in their proper context in the various issus, and the scholers have to activat it in the understanding of noble hadith; So that the Sunnah is not abused in other than what it has been legislate for, and as a result the jurisprudence is marginalized in front of modern life!
