دراسة مدى التأثير على البيئة، بحث في المفهوم والأساس القانوني.

الملخص
ينتهج القانون في وصفه القواعد القانونية المتعلقة بحماية البيئة الطابع الازدواجي في الصياغة (وقاية وجزاء)، فهو يحدد الاجراءات الوقائية الكفيلة بالحول دون وقوع الاعتداء على البيئة، ومن جهة أخرى يحدد الجزاءات المترتبة عن مخالفتها، ومن الأدوات التي أوردها المشرع الجزائري -على غرار القوانين الدولية-والتدابير الأمنية لضمان انتفاء المشاريع التنموية للأنشطة الإنسانية من صور الأضرار والإضرار بالبيئة، "دراسة مدى التأثير" على البيئة، كتدبير للتأكد من سلامة تلك النشاطات من المهددات للبيئة في عناصرها ومواردها. والإشكالية المطروحة حول هذه الأداة هي : المفهوم الحقيقي لها والأساس الذي استند عليه الفكر القانوني (الدولي أو الوطني) في اتخاذ مثل هذه الإجراءات. ومن أجل بحث هذه المسألة كان منّا وضع خطة تتمثل في التعريف بالأداة المتمثلة في دراسة مدى التأثير على البيئة، من قبل فقهاء القانون، وكذا تعريفها عند المشرع الجزائري، لنُتوِّج الدراسة بعدها بمحور حول بيان الأسس والمبادئ القانونية التي استند إليها في تشريع ذلك. Abstract: In describing the legal rules related to the protection of the environment, the law adopts a duplicative features in The protection of the environment (prevention and sanction), it takes some measures to reduce the occurrence of aggression on the environment, and on the other hand it defines the penalties for violating it, And the Algerian legislator has arranged security to ensure the exclusion of environmental damages, studying the extent of the impact on the environment, as measure to ensure the safety of these two activities from threats to the environment in its components and resources. The issue about this tool is : the real In concept of it and the basis on which the legal thought (international or national) was based on taking such measures. In order to discuss this issue, we had to develop a plan represented by the definition of the tool of studying the extent of the impact on the environment, by the jurists of law, as well as its definition by the Algerian legislator, And then we conclude by stating the legal foundations and principles on which the legislation was based.
