تعريفات مقاصد الشّريعة: مشكلاتها وحدودها - قراءة نقديّة لتعريفات المقاصد يفكّك مفاهيمها ويُعرّي ما فيها من جوانب القصور

الملخص
يأتي هذا البحث ناشدًا عددا من الأهداف يمكن إجمالها في أربعة: أوّلها: الكشف عن وجوه القصور في التّعريفات الحديثة التي تصدّت لتقديم مقاصد الشّريعة. ثانيها: تجلية وجوه الفرق بين المقاصد كغايات والمقاصد كمناهج تفكير وتشريع. ثالثها: بلورة تعريف للمقاصد يُغطّي أبعادها المختلفة. رابعها: التّمهيد لمراجعات عميقة لمقاصد الشّريعة تضمن لها الفعالية المنشودة في إدارة الشّأن التّشريعي وتطويره. وقد توخّيت منهجًافي العمل قدّرت أنّه الأقدر على النّهوض بتلك الأهداف قوامه أمور خمسة: يبدأ بتحليل مفهوميّ اعتمد التّفكيك أداةً أعملها في كثير مما اعترضني من تعريفات "المقاصد" قديما وحديثا. ويُثنّي برسم خرائط مفاهيمأستثمر فيها عمليّات التّفكيك السّابقة وأتوّج بها مسارات التحليل للمقاصد في ضوء تعريفات القدامى والمحدثين. ويتولّى في مرحلة ثالثة نقد التّعريفات في بِنيتها ومضامينها ومعجمها وتعرية جانب من اختلال التّوازن في تعريفات المحدثين حيث اهتموا بالمقاصد باعتبارها غايات وأسرارًا وأهملوا المقاصد باعتبارها مناهج وآليات تفكير. ليختم باقتراح تعريف للمقاصد الشّرعية... Research objectives can be summarized in four:Exposing the shortcomings of modern definitions of "Maqasid al Shariah"., Manifest the faces of the difference between "Maqasid al Shariah" as goals, and "Maqasid al Shariah" as methods of thinking and legislation.Elaborating a definition of "Maqasid al Shariah" that covers its various dimensions and Prepare in-depth reviews of "Maqasid al Shariah" to ensure the desired effectiveness in managing and developing legislative affairs.I envisaged working methods based on five things: Conceptual analysis: it was based on the deconstruction of the old definitions of the "Maqasid al Shariah" and the new ones,Concept mapping: in where I invest previous deconstruction processes,Criticism of definitions: in its structure, contents, and glossary,Exposing aspects of the imbalance in the new definitions: they took care of "Maqasid al Shariah" as goals and secrets, and neglected "Maqasid al Shariah" as methods and mechanisms of thinking and finally Proposing a new definition of "Maqasid al Shariah"
