دور الوقف في مواجهة الأزمات، أزمة مرض الكورونا أنموذجا (دراسة شرعية قانونية مقارنة)

الملخص
للوقف منذ صدر الإسلام دور اجتماعي بارز من خلال تقديم خدمات مجانية للمجتمع في شتى مجالات الحياة، ولذا كان هدفنا من هذه الدراسة: التذكير بالدور الرائد للوقف في إنشاء حضارة عظيمة سجّلها التاريخ بحروف من نور في صفحات مشرقة، فهو مؤسسة شيدت المستشفيات لعلاج المرضى بأرض الإسلام ولو لم يكونوا مسلمين، ومحاولة تشجيع المسلمين على وقف بعض ما يملكونه على سبل الخير لرفع الغبن عن المغبونين تعليميا أو صحيا أو معيشيا دون مقابل، فتوصلنا في نهاية هذه الدراسة إلى أنّ ضرورة: اهتمام الدولة بمؤسّسة الوقف حتمي لمواجهة الأزمات التي تواجهها في شتى المجالات: الاقتصادية والاجتماعية والثقافية، وسنّ تشريعات وقفية لضمان حماية الأملاك الوقفية من كلّ اعتداء، وفتح الباب على مصراعيه أمام المستثمرين الرّاغبين في هذا المجال وتقديم التسهيلات اللازمة لهم لتنميتها واستثمارها واستغلاها على أكمل وجه. Since the existence of Islam, the Stay has played a crucial role in society. It provided free significant services inside socities in many fields of life. Therefore, the goal behind this study was: Encourage muslims to do the stay on what they possess for the sake of righteousness in order to get rid of unfairness on the disadvantaged whether hygienically or didactically free of charge. To recall the importance of the stay in forming a great civilization in which history has written on bright pages in letters of light. It is an institution that built hospitals to treat every patient of Islamic lands even if not a muslim. In the end, we have concluded that: - It is high time government showed interest in the stay in order to face all the crisis whether economical, social, cultural or even political ones. - Enacting legislations of the stay to guarantee the protection of properties in addition to opening up for the investors who want to invest in such field to develop it to the maximum. .KEY WORDS: Endowment, crises, Corona disease
