إسهامات علماء الجزائر في علم التّوثيق-الإمام الونشريسيّ أنموذجا

الملخص
الملخّص: يعتبر علم التّوثيق من العلوم الّتي لها صلة وثيقة بواقع النّاس ومعاملاتهم، وبه تُحفظ حقوقهم وتُنظَّم حياتهم، لأجل ذلك اهتمّ العلماء به على مرِّ الأزمان والعصور، وصنَّفوا في ذلك مصنَّفات جليلة، وقد كان لعلماء الجزائر إسهام بيّن في خدمة هذا العلم سواء من النّاحية النّظريّة أو العمليّة. جاء هذا البحث المختصر مبرزا لجهود علماء الجزائر في علم التّوثيق، وذلك من خلال تتّبع كتب تراجم علماء الجزائر، ورصد من كان له اهتمام بهذا العلم سواء ممّن كان موثّقا مشتغلا بهذه المهنة، أو من كان له تصنيف في هذا العلم، وقد مثّلت لذلك بالإمام الونشريسيّ حيث أشرت إلى جهوده في خدمة علم التّوثيق، ثمّ ذكرت واقع التّوثيق في بلدنا الجزائر في العصر الحاليّ، من خلال بيان القوانين المنظّمة للتّوثيق باعتباره مهنة مشهورة في بلادنا، وفي الأخير تمّ بيان مدى العلاقة بين التّوثيق قديما في كتب الفقه، وما عليه الموثّقون في هذا الزمان، وذلك من خلال عقد مقارنة بين وثيقتيّ بيع إحداهما مبثوثة في كتب الوثائق والأحكام، والأخرى متعارف عليها في مكاتب التّوثيق ببلدنا. Abstract: Notarial science is one of the most important sciences that have a strong relationship with the reality of people and their transactions, and in which their rights are preserved and their lives are regulated. Therefore, scientists have been interested in it over the ages, and classified great works. This brief research highlighted the efforts of Algerian scientists in the science of Notarial science , through tracking the books of the definition of scientists in Algeria, and the collection of those who have an interest in this science, whether documented working in this profession, or who has authored in this science, and was represented by the Imam Alwancharisi ,I referred to his efforts in the service of documentary science, and then I mentioned the reality of documentation in our country, Algeria in the present era, by stating the laws regulating documentation as a famous profession in our country, and finally the extent of the relationship between documentation in the old books of jurisprudence, and what is documented in this Time, By comparing two sales documents, one of them is found in the books of documents and judgments, and other is recognized in the documentation offices of our country offices.
