ضمان سلامة ومتانة البناء -قراءة في النصوص المتعلقة بالبناء والتعمير-

الملخص
ملخص: ترتبط قوة وصلابة وسلامة المباني في الدولة بقوة الحضارة التي تنتمي إليها كما أنها تعبر عن تطور قدراتها ومؤهلاتها في ميدان البناء، ولأن العيب فيه أو تهدمه يتجاوز في تهديده للمصلحة الخاصة لمالكه أو المنتفع به إلى المصلحة العامة بتهديد النظام العام بعناصره الأربعة (أمن عام، صحة عامة، سكينة عمومية، المظهر العام الجمالي)، نجد التشريعات الوضعية وعلى غرار التشريع الجزائري قد توجه نحو تأطير عملية البناء والتعمير بشكل يضمن حماية النظام العام العمراني بكل عناصره المذكورة من خلال مجموعة من النصوص القانونية والتنظيمية لاسيما تلك المتعلقة بالبناء والتعمير. ومن خلال هذا المقال سوف نبحث عن الاليات التي قررها المشرع في النصوص القانونية المتعلقة بالبناء والتعمير ضمانا لسلامة المباني ومتانتها، من مختلف الأخطار التي يمكن أن تعترضها (الطبيعية، الاصطناعية)، وصولا إلى تقدير فعالية هذه الآليات وحدها لتحقيق ما يسمى بالنظام العام العمراني. Abstracrt: The strength, solidity and the safety of buildings in a country are related to the strength of the civilization to which they belong, also the development of their capabilities and qualifications reflect its field of construction, and because the defect in the building or its destruction exceeds its threat to the private interest of its owner or beneficiary to the public interest, threatening public order and its four elements (public security, public health, public safety and aesthetic overall appearance). We find statutory legislations similarly to the algerian legislation that has been directed towards framing the building and construction process in a way that guarantees the protection of the public urban system with all of its elements mentioned through a range of legal and regularity texts, especially those relevant to building and construction. Through this article, we will look for the mechanisms that the legislator has decided in the legal texts related to building and construction to ensure the safety and durability of buildings, from the various dangers that can be faced (natural, artificial), leading to estimate of the effectiveness of these mechanisms alone to achieve the so-called public urban system.
