النسب بين التلقيح الاصطناعي واستئجار الأرحام وأثرهما على الإستقرار الأسري

الملخص
من خلال هذا المقال سيتم معالجة موضوع مهم من مواضيع العلاقة الأسرية، وهو موضوع النسب، لما له دور في استمرار النسل البشري واستقرار المجتمعات، وسيتم معالجة جزئية مهمة فيه لها علاقة بالتطور العلمي في مجال الطب، متمثلة في التلقيح الاصطناعي، والذي يستعمل في مجال العلاج لحالات العقم بين الزوجين، وموضوع آخر له علاقة به هو موضوع استئجار الأرحام، والذي يعد طريقاً علاجياً لحصول الولد لبعض حالات العقم، إلا أن هذين الطريقين لابد أن يراعى وفق ضوابطه الشرعية، أتى بها الفقه الإسلامي، وأخرى قانونية حددها قانون الأسرة رقم 84/11 المعدل والمتمم بموجب الأمر 05/02، فمنها ما أجيز العمل بها، وأخرى تم منعها لما لها أثر على استقرار الأسرة واختلاط الأنساب، وهو ما سيتم توضيحه من خلال هذه الدراسة، بوضع الضوابط الشرعية والآليات القانونية التي تجيز للزوجين استعمال الطريق العلمي العلاجي لحصول الولد. Through this research paper, we will discuss an Important topic that concerns ” the family relationship” subject, which is the issue of lineage that has not only a huge role in the continuity of the human offspring but also the stability of societies. Some of the therapeutic ways that could be a solution to infertility is artificial insemination (used in the field of treatment of infertility between spouses). It represents a big scientific development in the medical field. In addition to “surrogacy” which is another way to help treat infertility, although these therapeutic methods are controlled by Islamic regulations that have been brought by the sharia’a controls and legal regulations.some of the methods have been permitted to use, but others were forbidden due to their impact on the family stability and the issue of mixing of lineages. All of the above will be clarified and explained in detail in this study by setting legal controls and legal mechanisms that allow spouses to use the correct scientific and therapeutic ways to obtain a child.
