الملخص
يتناول هذا المقال دراسة استخدام بروتوكول العنوان الالكتروني (TCP/IP)للوصول إلى الدليل الالكتروني لإثبات الجرائم ،ومعرفة مرتكبيها ،إذ يعد هذا الدليل سمة من سمات تطورات العصر الحديث في كافة النظم القانونية ،تلك التطورات جاءت لكي تماشى مع متطلبات الثورة العلمية والتقنية الحديثة في حياتنا اليومية ،و تهدف هذه الدراسة إلى معرفة ذاتية الدليل الالكتروني وما يتميز به عن باقي الأدلة الجنائية الأخرى ،وكذا آليات الحصول على الدليل الالكتروني باستخدام بروتوكول TCP/IP ،من خلال بيان أهم الإجراءات الفنية والقانونية المتبعة في التشريع الفلسطيني والجزائري . This article examines the use of the electronic address protocol (TCP / IP) to access the electronic evidence to prove crimes, and to know the perpetrators, as this is a feature of the developments of modern times in all legal systems, these developments came in line with the requirements of the scientific and technological revolution in modern This study aims to know the subjective electronic evidence and what distinguishes it from other forensic evidence, as well as the mechanisms of obtaining the electronic evidence using the protocol TCP / IP, by showing the most important technical and legal procedures followed in the Palestinian and Algerian legislation Connect to the electronic directory.
