الوضع القانوني للحرب السيبرانية على ضوء قواعد القانون الدولي

الملخص
تطورت وسائل وأساليب الحرب منذ اتفاقيات جنيف لعام ١٩٤٩، وتشكل الاسلحة السيبرانية مثالا متقدما للتكنولوجيا الحديثة،إذ تتم العمليات الحربية ضمن وعبر فضاء افتراضي وهو الفضاء السيبراني (الالكتروني). وفي ظل حداثة هذا النوع الجديد من الاسلحة وما نتج عن استخدامه من أثار مأساوية ضد الانسانية ،استوجب معه البحث في مشروعية هذا السلاح الجديد ومدى مطابقته لقواعد القانون الدولي خاصة في ظل غياب اتفاق دولي يحظر أو يقيد استخدام الأسلحة السيبرانية. Résumé: Les moyens et méthodes de la guerre ont évolué depuis les conventions de Genève de 1949, les armes cybernétiquesconstituent un exemple avancédela technologie moderne, où les opérations militaires se passent dans et à travers l'espace virtuel: cybernétique ou électronique.A la lumière de cette arme récente, les conséquences néfastes deson utilisation contre l'humanité,imposent la nécessité d’entreprendre une recherche sur sa légitimité et sa conformité avec les règles du droit international, en particulier en l'absence d'un accord international visant à interdire ou à la restreindre. Abstract : The ways and methods of the war have evolved since Geneva Conventions of 1949, the cybernetics weapons constitute an advanced example of modern technology, where military operations occur in and through virtual space(cyberspace): cybernetics or electronics. And in the light of this developed type of weapon and the fatal consequences of its use against humanity, required research on the legitimacy of this new weapon and the range of its conformity with the rules of the international law, in particular in the absence of an international agreement aiming to prohibit or restrict the use of the cybernetics weapons.
