الإطار القانوني لآلية التنازل عن العقار غير المبني الموجه لإنجاز السكن الجماعي المدعم من طرف الدولة

الملخص
ملخص : من بين ما يشتمل عليه نشاط الترقية العقارية حسب أحكام القانون رقم 11/04 المؤرخ في المؤرخ في 17 فيفري 2011 الذي يحدد القواعد التي تنظم نشاط الترقية العقارية ، إقتناء المرقي العقاري للأراضي التي سينجز فوقها مشروعه العقاري بموجب عقود يتم إعدادها في الشكل الرسمي و طبقا للأحكام التشريعية السارية المفعول . خروجا عن القاعدة العامة المتعلقة بآلية البيع بالمزاد العلني للأملاك العقارية التابعة للأملاك الخاصة للدولة أقر المشرع الجزائري آلية التنازل عن القطع الأرضية التابعة للأملاك الخاصة للدولة و الموجهة لإنشاء برامج السكنات المدعمة من طرف الدولة بهدف تذليل الصعوبات التي تعترض المرقين العقاريين عند البحث عن أرضية مناسبة بسند ملكية ثابت لإنجاز المشاريع السكنية الجماعية المدعمة من طرف الدولة و التي ستخضع لقواعد الملكية العقارية المشتركة عند شغلها من طرف الملاك الشركاء . Résumé : Selon les dispositions de la loi 11/04 du 17 février 2011 fixant les règles régissant l’activité de promotion immobilière, cette dernière comprend entre autres l’acquisition des terrains par le promoteur immobilier destinés à la réalisation de son projet immobilier sur la base de contrats officiels et conformément aux dispositions législatives en vigueur. S’écartant de la règle générale relative au mécanisme de la vente aux enchères des biens immobiliers relevant du domaine privé de l’état , le législateur algérien a approuvé le mécanisme de cession de terrains relevant du domaine privé de l’état et destinés à l’implantation de programmes de logements aidés par l’état afin de surmonter les difficultés rencontrées par les promoteurs immobiliers à la recherche d’un terrain approprié avec titre de propriété approuvé pour la réalisation des projets de logements collectifs aidés par l’état , lesquels seront soumis aux règles de copropriété immobilière une fois occupés par les copropriétaires . Abstract: According to the provisions of the law 11/04 of 17 February 2011 setting the rules governing the activity of real estate development, the latter includes among others the land acquisition by the real estate developer for the realization of his real estate project on the basis of formal contracts and in accordance with the legislative provisions in force. Departures from the general rule relating to the mechanism of the real estate auction sale in the private domain of the state, the Algerian legislator has approved the mechanism of the land transfer belonging to the private domain of the state and intended for the Implementation of state-assisted housing programs to overcome the difficulties faced by real estate developers in search of suitable land with approved title of property for the realization of collective housing projects supported by the state, which will be subject to real estate co-ownership rules once occupied by the co-owners.
