حماية الشاهد كالية لمواجهة الفساد في التشريع الجزائري (دراسة تحليلية )

الملخص
-إن جرائم الفساد تعد من الجرائم الخطيرة بطبيعتها ، بالنظر لانتشارها الواسع وصعوبة تتبع آثارها الأمر الذي اقتضى إيجاد آلية جديدة لمواجهة الظاهرة ، وهذا ما عملت عليه كل من اتفاقية الأمم المتحدة لمكافحة الفساد 2003، والمشرع الجزائري في القانون 06/01، التي أشادت بدور الشاهد وأهميته في الصد لمثل هذا النوع من الجرائم ، بالمقابل خصته بضمانات تكفل حمايته وبالتالي تسهل القيام بمهمته ،هذا و تتجلى أهمية البحث في أنه من المواضيع المستحدثة والهامة في وقتنا الحالي ، الذي نهدف من خلاله إلى التعرف على أوجه الحماية الشاهد في جرائم الفساد في ظل ما جاء به المشرع الجزائري والدولي ، وذلك بالاعتماد على المنهج تحليلي ، لنصل إلى نتيجة هامة مفادها أن غياب الأمن والاستقرار بالنسبة للشاهد يؤول دون شهادته وبالتالي ارتفاع حصيلة الجريمة ، وعليه نوصي بضرورة تفعيل جل الضمانات التي أوجدها المشرع لحماية الشاهد و تجسيدها على أرض الواقع . - Corruption crimes are serious crimes by nature, given their wide spread and difficulty in tracking their effects, which necessitated the creation of a new mechanism to confront the phenomenon, and this is what the United Nations Convention against Corruption 2003 and the Algerian legislator in Law 06/01, which praised the role of witness and Its importance in repelling this type of crimes, on the other hand, has been characterized by guarantees to ensure its protection and thus facilitate the implementation of its mission, and the importance of research is manifested in the fact that it is one of the topics created and important in our time, through which we aim to identify the protections witness in corruption crimes under the What the Algerian and international legislator sought, based on an analytical approach, to reach an important conclusion that the lack of security and stability for the witness comes without his testimony and therefore the high crime toll, and therefore we recommend that we recommend that all the guarantees created by the legislator be activated to protect the witness and its embodiment on the ground.
