التشهير بالسر الطبي للمريض(defamation Of The Patient's Medical Secret)

الملخص
إن استخدام الوسائل الإلكترونية أصبح أمرًا لا مفر منه على جميع الأصعدة وفي جميع المجالات العامة والخاصة؛ لأنها تؤدي إلى تسهيل أداء المهام وسرعة التعامل مع كافة المعلومات، فكان لزامًا على وزارة الصحة تطوير خدماتها من خلال إقحام التكنولوجيات الحديثة في قطاعها. ولا يخفى على أحد أنه منذ عقود طويلة ظلت طبيعة السجلات الطبية ثابتة في شكل ملف أو مجموعة من الأوراق التي كُتِبت عليها المعلومات بخط اليد حتى حدثت خلال الأربعين عام الماضية تطورات هائلة في علوم تكنولوجيا المعلومات – أحد أكثر العلوم البشرية تقدمًا وأعظمها تأثيرًا في حياة البشر – قادت تلك التطورات العلماء والمتخصصين في مجال الرعاية الصحية وتكنولوجيا المعلومات معًا إلى تصميم واختراع سجلات طبية إلكترونية تعتمد على الكمبيوتر بكل إمكانياته المتطورة من تخزين معلومات ومعالجة ونقل بيانات عن طريق ما نعرفه اليوم من شبكات معلومات ووسائل اتصال حديثة. وإن مدى سلطة الطبيب هذه وحجمها يقابلها التزامات خاصة لحماية المريض بعدم استغلال ضعفه ونشر صوره واستغلال ملفه الصحي بنشره على مستوى صفحات المواقع الاجتماعية أو على مستوى المؤسسة التي يعمل بها وبما يخالف ذلك تسبب ضررا نفسيا من الدرجة الأولى في نفسية المريض لأن خصوصيته قد اُنتهكت من خلال التشهير به الذي تدفع بالطبيب إلى جزاء يُعاقب عليه القانون. في هذا الإطار تواجه وزارة الصحة تحديات تتعلق بمدى خصوصية وأمن المعلومات الطبية الإلكترونية، فكلما زادت سهولة الوصول إلى تلك المعلومات زادت أهمية إنشاء المزيد من قواعد الأمن والخصوصية التي تحكم عملية استخدام المعلومات وحق الاطلاع عليها. Abstract The use of electronic means has become inevitable at all levels and in all public and private sections because it facilitates performing tasks and speeding data mining. The Ministry of Health had to develop its services through the introduction of modern technologies in its sector. For decades, it is no secret that the medical records have remained constant in a form of files or a collection of manuscripts; yet, within the last 40 years there have been tremendous advances in information technology science, one of the most advanced and most influential human sciences in human life. These developments led scientists and healthcare and information technology professionals, together, to design and invent electronic medical records based on highly capable computers for storing, processing and transferring data through information networks and modern means of communication. The doctor's authority is bound with a set of obligations to protect the patients’ medical secret neither by exploiting their weaknesses, publishing his images nor publishing his health file on the level of social websites. During his defamation, the doctor shall be objected to a penalty and punishment by law. In this context, the Ministry of Health faces recurrent challenges related to the privacy and security of electronic medical information. The more easily accessible, the more important it is to establish more security and privacy rules governing the use and access to information.
