الملخص
ملخص: يعتبر الطعن ببطلان التصرفات خلال فترة الريبة من أهم ضمانات حقوق دائني التاجر المفلس، إذ يهدف إلى المحافظة على الضمان العام و تحقيق المساواة بين الدائنين. غير أنه بالنسبة للمدفوعات في الحساب الجاري خلال فترة الريبة فإن مبدأ التماسك أو عدم تجزئة المفرادات يحول دون إمكانية الطعن بالبطلان، لذلك حاول القضاء حماية حقوق الدائنين من خلال الحد من هذا المبدأ متى كان القصد من الدفع في الحساب الجاري هو الإضرار بجماعة الدائنين. SUMMARY: An appeal against theinvalidity of conduct during the suspect period is considered as one of the most important guarantees of the rights of creditors’ bankrupt merchant. It aimsat maintaining general security and achieving equality between creditors. However, for payments in the current account during the suspect period, the principle of cohesion or the indivisibility of concepts disappear without the possibility of invalidity. Hence, the judiciary has attempted to protect the rights of creditors by limiting this principle when the current account payment intends to harm the creditor community.
