الملخص
ملخص البحث: يتناول هذا البحث مسألة توجيه الأقوال والأجوبة الفقهية؛ وهي جملة الفتاوى والمسائل التي وردت عن الأئمة والمجتهدين، وذلك أن كل قول أو فتوى أو اجتهاد في الدين إلا وله مستند شرعي يرجع إليه، وفي كثير من الأحيان لا يصرّح المجتهد بمأخذه ومستنده في ذلك القول، مكتفيا بإجابة سائله أو تقرير فتواه، ولعل هذا الأمر أبعد كثيرا من المقلدة عن طلب الدليل، تحت غطاء: دليل العامي فتواه –ولا إشكال في ذلك- مادام المجيب من الأئمة الثقات المعتبرين في جانب الفتوى. إلا أن طالب العلم لا يجوز في حقه إلا طلب الدليل، مع الحرص على البعد عن اتهام الفقهاء والمفتين بعدم الدليل؛ لأن خفاء الدليل لا يستلزم بطلان القول أو تركه. وفي هذا البحث شيء من التنظير لمصطلح التوجيه الفقهي في المذهب المالكي، وبيان لبعض معانيه، مع التفريق بينه وبين بعض المصطلحات المشابهة، وذكر بعض الأمثلة والنماذج الفقهية من أمهات كتب المذهب وغيرها من المؤلفات والمراجع الأصيلة. الملخص بالترجمة الإنجليزية: Research Summary This research deals with the issue of directing statements and jurisprudential answers; which is a set of fatwas and issues that have been received about the imams and the hard-working, because every statement or fatwa or ijtihad in religion only has a legitimate document to which he refers, By answering his question or deciding his fatwa, perhaps this is far from imitations from the request for evidence, under the cover of: The evidence of the colloquial fatwa - and no problem with that - as long as the respondent of the imams trusts considered on the side of the fatwa. However, the applicant of science may not be in his right only to request evidence, taking care to avoid accusations of scholars and muftis lack of evidence; because the concealment of evidence does not require invalidity of saying or leave. In this research some of theorizing the term of jurisprudence guidance in the Maliki school, and a statement of some of its meanings, with a distinction between him and some similar terms, and mentioned some examples and models of jurisprudence from the mothers of the books of the doctrine and other literature and authentic references.
