الملخص
ملخص: تناولت في هذا البحث وثيقة البيع بين الماضي والحاضر، وذلك من خلال المقارنة بين الفقه الإسلاميّ والقانون الجزائريّ في تقييد وثيقة بيع العقار، ويهدف البحث إلى الإجابة عن إشكاليّة تتمثّل في سؤال: هل وثيقة البيع من ابتكارات أهل العصر، أم أنّها ترجع إلى تراثنا الفقهيّ؟، وقد ذكرت في البحث ما يتعلّق بمفهوم وثيقة البيع وحكم كتابتها، وما يتعلّق بشروط كاتب وثيقة البيع ومواصفاتها ، وذلك من خلال المقارنة بذكر وجوه الوفاق والخلاف، ومن خلال ذلك توصّل الباحث إلى الصّلة الوثيقة بين التّراث الفقهيّ والتّنظيمات المعاصرة المتعلّق بهذا الشّأن. Abstract: This paper deals with the sale of real estate between the past and the present, by comparing Islamic jurisprudence with Algerian law in writing the sale of real estate. The research aims to answer the problem of: Is the sale document of the inventions of the modern era, or is it due to our jurisprudential heritage? I mentioned in the research what is related to the concept of the sale document and the rule of writing it, and what is related to the conditions and specifications of the author of the sale document, by comparing the aspects of concord and disagreement, and through this researcher reached a close link between the jurisprudential heritage and contemporary organizations related to this matter. Résumé : Cet article traite de la vente de biens immobiliers entre le passé et le présent en comparant la jurisprudence islamique avec le droit algérien lors de la vente de biens immobiliers. L'étude vise à répondre au problème suivant: le document de vente des inventions de l'ère moderne est-il dû à notre héritage jurisprudentiel? J'ai mentionné dans la recherche ce qui est lié au concept de document de vente et à sa règle d'écriture, et ce qui est lié aux conditions et spécifications de l'auteur du document de vente, en comparant les aspects de concorde et de désaccord, et par ce chercheur est parvenu à établir un lien étroit entre le patrimoine jurisprudentiel et les organisations contemporaines qui s'y rapportent.
